Federal Government will not Interfere with Cannabis activity on Tribal Lands

Native Tribes are sovereign entities and their borders can cross state or federal district boundaries. As the patchwork of Cannabis legislation continues to grow, tribes have been looking for clarification regarding the enforcement of the Controlled Substance Act.

The Department of Justice released this memo which closely reflects the positioning outlined in the 2013 Cole Memo. It provides 8 points that prosecutors should use to prioritize their efforts but also reiterates that, "Nothing in the Cole Memorandum alters the authority or jurisdiction of the United States to enforce federal law in Indian Country. Each United States Attorney must assess all of the threats present in his or her district, including those in Indian Country, and focus enforcement efforts based on that district-specific assessment."
